These Terms and Conditions (“Terms”) govern your access to and use of the DeliV mobile app, website, and related services (collectively, the “Platform”), operated by DeliV Technologies (“we,” “our,” or “us”).
By accessing or using DeliV, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
DeliV connects customers, vendors, and delivery partners through a single platform.
Users can:
Order food, groceries, and other goods from local vendors.
Manage deliveries and payments securely.
Promote events, products, or services (for vendors).
To use DeliV, you must:
Be at least 18 years old (or the age of majority in your country).
Have the legal capacity to enter into this agreement.
Provide accurate and complete registration information.
If you register on behalf of a business, you represent that you are authorized to bind that entity.
You must create an account to access most DeliV features.
You agree to:
Provide accurate and updated information.
Keep your login credentials secure.
Be responsible for all activity under your account.
We may suspend or terminate accounts involved in fraudulent, abusive, or illegal activities.
Vendors listed on DeliV are independent businesses, not employees or agents of DeliV.
Prices, availability, and delivery times are determined by vendors.
Once an order is confirmed, cancellation may not be possible.
DeliV acts only as a technology intermediary to connect customers, vendors, and couriers.
Payments are processed through secure third-party gateways.
Taxes, delivery fees, and service charges may apply.
You authorize DeliV or its payment partners to charge your selected payment method.
Refunds are handled according to the vendor’s or DeliV’s refund policy.
DeliV may offer promotional codes, referral bonuses, or loyalty rewards.
These:
Have no cash value.
May expire or be revoked at any time.
Cannot be sold, transferred, or combined with other offers.
You agree not to:
Misuse the Platform or attempt unauthorized access.
Post false information, spam, or illegal content.
Harass, threaten, or abuse other users or partners.
Circumvent payment systems or engage in fraudulent activity.
Violation of these terms may result in account suspension or permanent ban.
Vendors and delivery partners must:
Comply with all local laws, health, and safety regulations.
Ensure accurate listing of menu, prices, and availability.
Maintain professionalism and timely service.
DeliV reserves the right to delist or deactivate any vendor or partner violating our policies.
When using DeliV for paid events or promotions:
Payments generate a unique QR code for entry verification.
DeliV is not responsible for event cancellations or disputes between organizers and attendees.
Refunds are processed according to each event’s policy.
Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your information.
By using DeliV, you consent to such processing and confirm that all data provided is accurate.
All content, trademarks, and software related to DeliV are owned by DeliV Technologies or its licensors.
You may not:
Copy, distribute, or modify the Platform’s content.
Use our name, logo, or brand without written consent.
To the maximum extent permitted by law:
DeliV provides the Platform “as is” without warranties of any kind.
We are not liable for service interruptions, delays, or losses caused by vendors, couriers, or external systems.
Our total liability shall not exceed the amount paid by you in the past 3 months for the affected service.
We may suspend or terminate your account if:
You violate these Terms.
You engage in fraudulent or abusive behavior.
Required by law or regulatory authority.
You may delete your account anytime through the app settings.
We may update these Terms occasionally.
Any changes will take effect immediately upon posting on the Platform. Continued use means you accept the new Terms.
These Terms are governed by the laws of Florida, United States, without regard to conflict of law principles.
Any dispute will be resolved through binding arbitration or in a court of competent jurisdiction in Miami, FL.
